Please read these Terms of Service ("Terms") carefully before using the twinstarac.com website (the "Site") or engaging our HVAC services (the "Services"). By accessing or using our Site or Services, you agree to be bound by these Terms. If you disagree with any part of these Terms, you may not access the Site or use our Services.

1. Services Provided

TwinStar Air Conditioning & Heating LLC provides residential and commercial HVAC services, including but not limited to:

  • Emergency AC repair
  • AC repair and maintenance
  • AC installation and replacement
  • Heat pump services
  • Commercial HVAC services
  • HVAC inspections

All services are provided by licensed and EPA-certified technicians in accordance with applicable federal, state, and local laws and regulations.

We provide services in New Caney, Kingwood, Porter, Atascocita, Humble, North Houston, and surrounding areas in Texas.

2. Service Requests and Quotes

Scheduling

Service appointments may be scheduled by phone at (832) 405-5906, through our website contact form, or via text message. We will make reasonable efforts to accommodate your preferred appointment time.

Quotes and Estimates

  • Installation quotes are provided free of charge with no obligation.
  • Repair diagnostics require an $89 diagnostic fee.
  • Diagnostic fee is waived for first-time customers.
  • Diagnostic fee is waived if you proceed with recommended repairs.
  • All quotes are valid for 30 days from the date provided.
  • Final pricing may vary if additional issues are discovered during service.

Appointment Changes and Cancellations

If you need to reschedule or cancel an appointment, please provide at least 24 hours' notice. We reserve the right to charge a cancellation fee for same-day cancellations or no-shows.

3. Pricing and Payment

Payment Terms

  • Payment is due upon completion of services.
  • We accept cash, Visa, Mastercard, American Express, and Discover.
  • Financing options are available for qualified customers on purchases over $500.

Pricing

  • All prices are in U.S. Dollars.
  • Prices are subject to change without notice.
  • Emergency service after business hours includes a $150 premium fee.
  • The emergency fee is waived if you proceed with repair.

Additional charges may apply for:

  • Permits and inspections
  • Special parts or equipment
  • Extensive ductwork modifications
  • Services outside our standard service area

Late Payments

Unpaid balances may be subject to interest charges at the rate of 1.5% per month (18% annually) or the maximum rate permitted by law, whichever is lower.

4. Warranties and Guarantees

Service Warranty

  • All repairs come with a 30-day satisfaction guarantee.
  • If the same issue reoccurs within 30 days, we will return to repair at no additional charge.
  • Installation labor is warranted for 1 year from date of installation.

Equipment Warranty

  • New equipment is covered by the manufacturer's warranty (typically 5-10 years on parts).
  • Warranty terms vary by manufacturer and equipment model.
  • We will assist with warranty claims but are not responsible for manufacturer warranty fulfillment.
  • Manufacturer warranties may require proof of regular maintenance.

Warranty Limitations

Warranties do not cover:

  • Damage caused by misuse, abuse, or neglect.
  • Normal wear and tear.
  • Damage from natural disasters, power surges, or acts of God.
  • Repairs or modifications performed by unauthorized parties.
  • Systems that have not received recommended maintenance.

5. Customer Responsibilities

As a customer, you agree to:

Access:

  • Provide clear access to all HVAC equipment
  • Remove obstacles that may impede service
  • Ensure pets are secured during service visits
  • Notify us of any safety hazards on your property

Information:

  • Provide accurate information about your HVAC system and issues
  • Disclose any previous repairs or modifications
  • Inform us of any special circumstances (e.g., occupied by elderly or infants)

Maintenance:

  • Follow recommended maintenance schedules
  • Change air filters regularly
  • Report issues promptly to prevent further damage

Payment:

  • Pay for services in full upon completion
  • Maintain valid payment information for financed purchases

6. Limitation of Liability

Service Limitations

TwinStar Air Conditioning & Heating LLC is not liable for:

  • Pre-existing conditions not discovered during initial inspection.
  • Damage to property caused by defective equipment or systems we did not install.
  • Delays in service due to circumstances beyond our control (weather, parts availability, etc.).
  • Consequential damages (e.g., spoiled food, lodging costs, lost business revenue).

Maximum Liability

To the fullest extent permitted by law, our total liability for any claim arising from our services shall not exceed the amount you paid us for the specific service in question.

We disclaim all other warranties, express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose.

7. Emergency Services

Emergency services are available 24/7 for urgent situations. We will make reasonable efforts to respond promptly, but response times may vary based on:

  • Technician availability
  • Weather conditions
  • Traffic and road conditions
  • Volume of emergency calls

Emergency service does not guarantee immediate resolution - some repairs may require parts that must be ordered.

8. Permits and Compliance

Permits: When required by local ordinances, we will obtain necessary permits for HVAC installation work. Permit fees are the responsibility of the customer and will be included in the quoted price.

Code Compliance: All work will be performed in accordance with applicable building codes and regulations. However, we are not responsible for bringing pre-existing non-compliant systems up to current code unless specifically contracted to do so.

9. Intellectual Property

All content on the twinstarac.com website, including text, graphics, logos, images, and software, is the property of TwinStar Air Conditioning & Heating LLC or its licensors and is protected by U.S. and international copyright laws. You may not reproduce, distribute, or publicly display our content without permission.

10. User Conduct

When using our Site or Services, you agree to:

  • Provide accurate and truthful information
  • Not use the Site for any unlawful purpose
  • Not transmit viruses, malware, or harmful code
  • Not harass, threaten, or abuse our staff
  • Not interfere with or disrupt our services

12. Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions.

Arbitration: If we cannot resolve a dispute informally, you agree that any claim or dispute shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Montgomery County, Texas. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as a class action.

13. Indemnification

You agree to indemnify, defend, and hold harmless TwinStar Air Conditioning & Heating LLC, its owner, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of our Services, your violation of these Terms, or damage to property caused by your actions or negligence.

14. Severability & Entire Agreement

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and TwinStar Air Conditioning & Heating LLC regarding the use of our Site and Services, and supersede all prior agreements and understandings.

16. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify you of any changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our Site or Services after any modifications indicates your acceptance of the updated Terms.
